GENERAL TERMS AND CONDITIONS

  • Order Form

The Client acknowledges that the Order Form shall become binding and constitute an agreement between the Parties upon the signing of the Order Form and its return by the Client to J2 Group Malta.

  • Payment Terms

Upon the signing of the Order Form, the Client agrees and binds himself to pay the deposit on account as indicated in the Order Form. Payment of remaining balance shall be affected upon tendering of invoice to the Client by J2 Group Malta. In the event of default by the Client in paying the remaining balance due to J2 Group Malta, interests shall start to accrue at the highest rate permissible by law until the date of effective payment.

All payments due by the Client to J2 Group Malta shall be paid in Euro to the following bank details:

  • Cancellation

In the event that the Client cancels the order following the signing and return of the Order Form, the deposit paid on account by the Client shall be forfeited in its totality in favour of J2 Group Malta.

  • Licensing (if applicable)

If the Order Form consists of a subscription of any license to be purchased by the Client, such subscription shall be automatically renewed upon the expiry of its term, unless the Client informs J2 Group Malta of his intention to terminate the subscription at least three (3) months in advance prior to the date of expiry.

  • Warranty, Indemnity and Liability

J2 Group Malta shall provide and deliver to the Client the equipment/item as described in the Order Form. The Client shall enjoy the rights as provided by the Consumer Affairs Act – Chapter 378 of the Laws of Malta, and any issue which may results shall be resolved in terms of the afore-mentioned act.

J2 Group Malta shall not be held liable for any action, claim, loss, debt and/or liability, actual or contingent, arising following delivery, or for damage caused by the negligence or fault of the Client, or due to an unforeseeable force.

  • Data Protection

The Client is hereby informed that J2 Group Malta, as a data controller, shall process, both manually and by electronic means, the Client’s personal data. J2 Group Malta will only process data specifically provided by the Client. Processing shall be limited to what is necessary for the purpose of J2 Group Malta providing its services. The Client’s personal data will not be kept by J2 Group Malta for a period longer than necessary for providing its services.

J2 Group Malta, being responsible for data processing and data collection, is obliged to provide information about data processing and data collection to the Client. The data protection information can be accessed in its current version at www.j2groupmalta.com. In addition, the information can be requested by email, telephone or postal mail.

  • Delivery and Acceptance

J2 Group Malta agrees to deliver the equipment/item to the Client within the agreed-upon timeframe. Upon delivery, the Client shall have a maximum of 24 hrs to inspect and accept the delivered goods. Acceptance shall be deemed to have occurred unless the Client notifies J2 Group Malta in writing of any non-conformities within the specified inspection period.

  • Severability

If any provision of this Agreement is held to be invalid or unenforceable under applicable law, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

  • Governing Law and Jurisdiction

This Agreement shall be governed by and construed under the laws of Malta. In the event of a dispute, the Client and J2 Group Malta agree on the jurisdiction of the Maltese Courts.
